被告人:杨啸,1984年2月因犯盗窃罪被判处拘役六个月；2008年11月因吸食毒品被强制隔离戒毒二年。因涉嫌盗窃犯罪于2010年3月31日被逮捕。现羁押于上海市杨浦区看守所。

上海市杨浦区人民检察院以沪杨检刑诉〔2010〕199号起诉书指控被告人杨啸犯盗窃罪，于2010年4月19日向本院提起公诉。本院依法适用简易程序，实行独任审判，公开开庭审理了本案。上海市杨浦区人民检察院未派员出庭支持公诉，被告人杨啸到庭参加诉讼。现已审理终结。

公诉机关指控：2008年11月1日16时许，被告人杨啸在本市杨浦区民主一村38号203室其叔叔杨建荣家做客期间，从卧室床头柜里偷得一只信封内有人民币3,000元后逃逸。公诉机关确认被告人杨啸的行为已构成盗窃罪，鉴于被告人杨啸在被强制戒毒期间，主动交代自己犯罪事实，是自首，可以从轻处罚，提请对被告人杨啸予以惩处。本院经审理查明的事实与公诉机关指控一致。另查明，被告人杨啸所窃赃款被其花用殆尽。

上述事实，被告人杨啸在开庭审理过程中亦无异议，并有被害人杨建荣、巫秀妹的陈述，被窃现场的照片等，公安机关出具的“工作情况”等证实，足以认定。

本院认为，被告人杨啸以非法占有为目的，窃取公民财物，数额较大，其行为已构成盗窃罪。公诉机关指控的罪名成立，对被告人杨啸依法应予惩处。鉴于被告人杨啸在被强制戒毒期间，如实供述司法机关还未掌握的本人盗窃犯罪行为，以自首论，本案适用简易程序审理，依法可以从轻处罚。被告人杨啸的犯罪事实、情节、对社会的危害程度及认罪态度等具体情况均在量刑中综合予以考虑。为严肃国法，保护公民财产的所有权不受侵犯，依照《中华人民共和国刑法》第二百六十四条、第六十七条、第五十三条、第六十四条之规定，判决如下：

一、被告人杨啸犯盗窃罪，判处拘役五个月，罚金人民币一千元；

（刑期从判决执行之日起计算。判决执行以前先行羁押的，羁押一日折抵刑期一日，即自2010年3月31日起至2010年8月30日止；罚金自本判决发生法律效力之日起十日内向本院缴纳。）

二、赃款予以追缴。
