一、研究背景

我国的个人所得税法诞生于1980年, 至今已有三十多年的历史。虽然税制改革的步伐从未停止过, 税收制度也在不断地完善, 但是个人所得税在我国现行诸税种中依然被公认为税收流失最为严重的一个税种。而英国是最早开征个人所得税的国家, 从1799年至今, 已经有两百多年的历史了。英国个人所得税法无论从地位上还是成熟程度上都超前于我国。本文通过中英两国个人所得税的比较, 找出我国存在的差距和问题, 为促进个人所得税改革, 完善个人所得税制度提出了一些建议。

二、中英个人所得税现状

个人所得税是由法律规定, 自然人应该向政府缴纳的收入的一部分。各地政府在不同时期对个人应纳税收入的定义和征收的百分比不尽相同。自从我国个人所得税开征以来, 随着经济的发展和国民收入水平的不断提高, 分别在1994年、2006年、2011年经历3次大的改革与调整。其中2011年6月30日修改法所涉及的减税额是开征以来最大的一次, 个人所得税起征点从2000元提高到3500元。2011年个人所得税实现收入6054亿元, 占总税收的6.7%, 个人所得税已经成为我国的主要税源。然而, 我国个人所得税的征收、管理以及个人纳税意识、监督等方面还存在诸多问题, 尚未显示出其本应该具有的强大作用。

英国可以称得上是世界上个人所得税制度较为完善的国家。其个人所得税的理论与实践已相对完善, 个人所得税从一个次要税种一跃成为主体税种, 使其成为国家财政收入的主要来源之一。无论是从个人所得税历史沿革、税收立法、税权划分、税收功能、税制要素, 还是从税收立法的完备性、征税稽查的严密性以及公民性体纳税意识, 一直是各国学习借鉴的榜样。

三、中英个人所得税的比较

本文从个人所得税收模式、税制设计以及税权划分三方面分别具体分析英国与我国个人所得税的不同之处。

(一) 个人所得税制模式比较

目前世界各国个人所得税课税模式一般分为三种:分类所得税制、综合所得税制、混合所得税制 (分类综合所得税制) 。英国采用的是综合所得税制, 即综合纳税人全年各项收入的总和, 对根据法律规定减除各项法定的宽免额和扣除额之后的净额, 采用累进税率计征, 这就不仅拓宽了所得税的基础以及符合支付能力原则, 而且也是非常简便合理, 易于征收和管理, 发挥了税收的管理效率。相较而言, 我国个人所得税的起步是比较晚、发展的还不是十分成熟, 现行的个人所得税制属于具有较少综合性的分类所得税制。我们必须学习英国的成功经验, 建立符合我国国情的综合个人所得税制。

(二) 个人所得税制设计比较

英国累进税率的级距适中, 分别为:起征储蓄所得税税率10%, 基础税率20%, 较高税率40%, 额外税率50%。其次, 各级覆盖的范围比较广。根据英国皇家税收与关税局 (HMRC) 的数据:2011-2012年度英国全年个人应缴纳所得税税额在2560英镑以下的属于储蓄起征税率;基础税率适用于个人年应缴纳所得税税额35, 000英镑以内;较高税率适用于年应缴纳收入从35, 001英镑至150, 000英镑;年应缴纳收入超过150, 000英镑的需缴纳额外税率。此外, 英国税制设计科学, 税率计量比较合理。通过比较可以看出, 我国累进税率级距过多。虽然经过2011年度个税法的改革, 现行工薪所得已从原来的9级减少为7级, 取消了15%和40%两档税率, 扩大5%和10%两个低档税率的适用范围。但是没有从根本改变边际税率与实际生活中的收入结构不匹配的现象。大部分边际税率还是不适用。根据测算, 全国工薪收入者扣除3500元费用和三险一金后需要缴纳个人所得税的人只有2400万, 大部分只适用3%和10%的前两级税率。我国月工资在8万元以上的人可谓凤毛麟角, 月工资在4万元以上的也不多。所以税率级距中心的第五级至第七级税率缺乏实际意义, 并且35%、45%的高边际税率没有多少人适用, 却使我国税制空背高税负之名。必须从更大范围内采取多种措施, 科学合理的进行税制设计, 发挥更大的作用。

(三) 个人所得税权划分比较

在英国, 税收管理权是集中被中央政府掌握的:不仅是主要税源以及税种高度掌握在中央政府的手中, 而且绝大部分的税收收入也都由中央政府支配与使用的, 即由中央政府来负责立法、征收以及管理。而我国则是把个人所得税立法权归属中央, 征收权则归属于地方政府, 就收益权而言则成为中央政府与地方政府共享税了。它的调节收入分配的功能并没有十分有效地发挥, 不利于缩小收入分配。将个人所得税划归地方政府征收, 相较而言就比较难以全面落实中央政府强化个人所得税征管的宏观调控措施, 不利于维护国家的税收管辖权, 比较难以搞好税收分配关系。加之税收监管不是非常有力, 就容易出现偷税漏税的现象, 难以保证税收的公平与公正。

四、完善我国个人所得税制度的建议

通过对中英个人所得税比较, 完善我国个人所得税制度必须加快税制改革步伐, 优化税制要素设计, 采用科学税制模式, 提高税收征管效率。

(一) 加快税制改革步伐

个人所得税制的改革有一个漫长的过程, 它的改革以及完善应该与不同阶段的经济发展相适应。以英国为例, 个人所得税由最初的临时性措施开始, 逐渐演变成一个固定的税种, 到现在成为主要的税源之一, 期间经历多次改革与探索, 根据不同时期的经济发展而不断对其进行完善。它的功能从最初的只是增加国家财政收入, 逐渐演变成为具有调节经济功能的杠杆。所以必须认识到税制改革的道路是十分漫长的, 必须根据税制改革的目标政策建立科学有效的税制制度。

(二) 优化税制要素设计

税制要素的设计, 这是非常有利于完善我国个人所得税制度的。英国个人所得税制度的要素设计相较而言比较完备, 税费扣除标准也是比较合理、税率结构非常科学, 充分体现了“宽税基、低税率”原则, 有利于对税收的征管。英国所采用的制度的宗旨是有收入就纳税, 宽税基既增进公民意识, 又便于“削峰填谷”。而我国目前个人所得税制度在费用扣除方面的规定相较而言就过于简单, 没有十分详细地区分为取得收入所支付的必要费用和生计费用, 对纳税人一律实行定额 (定率) 扣除, 这就难以体现能力负担的原则, 容易造成不同纳税人的税负不公平。必须拓宽税基, 调整税前的费用, 明确扣除的标准, 合理调整税率及级距, 简化税收制度, 实现公平税负。

(三) 采用科学税制模式

从全世界各国实践经验来看, 综合所得税制是目前最被普遍运用的所得税制, 同时也是被大家公认为比较理想的税制模式。据不完全统计, 目前有80%的国家采用综合所得税制, 它是按照所得主体一个纳税年度内的全部收入综合计算征税的, 对各类纳税人和各类所得采取同等对待, 因此能够较好地体现了公平税负和量能负担的原则, 这种制度是目前较为成熟的一种税制, 它实现税负公平以及具有调节收入再分配的偏好, 已经取得了实践上的成功, 是我国税制改革追求的目标模式之一。

(四) 提高税收征管效率

中国个人所得税制度相较而言是比较缺乏监督机制, 把公民的许多收入置于“放羊”状态, 除了工资、稿酬等少数酬劳是由发放单位代扣而无法逃税外, 其他个人收入有许多都可以通过不同途径进行逃税漏税, 这也是中国官员容易腐败的原因之一, 腐败官员可随时携带巨额赃款外逃。因此必须建立严密的社会化监控体系, 把对个人所得税征收管理的全过程包括税务登记、税源汇总、税款征收、完税注销、资料保管等工作进行全方位的监控。实现税务机关与银行、海关、工商、保险、审计等部门间的联网操作。建立网上稽查制度, 形成全社会监税、护税、征收、稽查网络, 从而提高个人所得税的征收效率。
